Terms of Use
These terms are an agreement between you and CodePixelfy LLC, a Delaware limited liability company ("we", "us"), for the Spinhue app, its browser version and this website (together, "Spinhue"). By downloading or playing Spinhue you agree to them. If you don't agree, please don't use Spinhue.
1. License
We give you a personal, non-exclusive, non-transferable, revocable license to use Spinhue for your own entertainment on devices you own or control, as allowed by the Apple Media Services Terms. You may not copy, modify, reverse engineer, resell or redistribute Spinhue, except where the law allows it regardless of this restriction.
2. Purchases and virtual items
- All purchases are processed by Apple and are subject to Apple's terms. Prices are shown in the App Store before you buy.
- Coins, boosters and other virtual items have no real-world monetary value, cannot be exchanged for cash, and cannot be transferred or sold. They are a limited license to use content in the game, not property you own.
- Coins and items are stored on your device. Non-consumable purchases (Starter pack, Remove ads) and active subscriptions can be restored with Restore purchases. Consumed or unspent coins may be lost if you delete the app or change devices.
- Refunds are handled by Apple at reportaproblem.apple.com. We cannot issue refunds ourselves.
3. Spinhue+ subscription
Spinhue+ is an auto-renewing monthly subscription. Payment is charged to your Apple ID when you confirm the purchase. It renews automatically at the same price unless you turn off auto-renew at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before that end. You can manage or cancel the subscription in iPhone Settings, under your name, Subscriptions. Cancelling stops future renewals; the current period stays active until it ends.
4. Ads
The free version shows ads, including optional videos that give in-game rewards. Rewards are granted only when a video is watched to the end and may not be available at all times. Our Privacy Policy explains the data involved.
5. Fair play
Please don't cheat, exploit bugs, tamper with the app or its data, or use Spinhue in a way that breaks the law or harms others. We may fix exploits and reset items obtained through them.
6. Ownership
Spinhue, its name, design, code, art and sounds belong to CodePixelfy LLC. Sharing your own scores and screenshots is welcome.
7. Changes and availability
We may update, change or remove features, levels, prices or items, and may stop offering Spinhue. We will try to give notice of major changes in the app. We may update these terms; the date above shows the latest version, and continuing to play means you accept the update.
8. Disclaimer
Spinhue is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, including fitness for a particular purpose and non-infringement, and we don't promise that Spinhue will be uninterrupted or error-free. Nothing in these terms limits rights you have under consumer law that cannot be waived.
9. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, virtual items or profits. Our total liability for any claim is limited to the amount you paid for Spinhue purchases in the 12 months before the claim, or USD 50 if you paid nothing. Some places don't allow these limits, so they may not apply to you.
10. Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. If you are a consumer in the EEA, UK, Switzerland or Serbia, you also keep the protection of the mandatory laws of your country and may bring claims in your local courts.
11. Apple
- These terms are between you and CodePixelfy LLC only, not Apple. We, not Apple, are responsible for Spinhue and its content.
- Apple has no obligation to provide maintenance or support for Spinhue.
- If Spinhue fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation for Spinhue.
- We, not Apple, are responsible for addressing any claims relating to Spinhue, including product liability, legal or regulatory compliance, consumer protection, privacy, and intellectual property claims.
- You confirm you are not located in a country subject to a US Government embargo or on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
